These terms govern your use of WeBuzz, operated by WeBuzz Inc., a Delaware corporation. By creating an account or using the service you agree to them.
What WeBuzz does
WeBuzz gives a business the tools to run a referral program, and gives the people sharing that business a link, a record of what their sharing produced, and a way to receive whatever reward the business has offered.
Eligibility
You must be at least 18 years old and able to enter a contract. You are responsible for what happens under your account, including keeping your sign in credentials safe.
Rewards are set by the brand, not by us
The business running a program decides what its rewards are, what has to happen to earn one, and when a reward is approved. We operate the mechanism. We do not promise you any reward, any amount, or any particular earnings, and a brand can change or end its own program. Where a reward is paid in cash it is paid through Stripe, and where it is paid as a gift card it is fulfilled by a third party. Tax on anything you receive is your responsibility, and we may need tax paperwork from you before a payment can be made.
What you must not do
- Refer yourself, or create accounts, identities, or devices to make a referral look real when it is not.
- Generate clicks or signups by automation, incentive, or paid traffic where a program forbids it.
- Spam anyone. Do not send unsolicited messages, and follow the law that applies to your message, including the rules on email and text messaging.
- Misrepresent a brand, or promise anything on a brand's behalf that the brand has not authorised.
- Attack, probe, or attempt to break the service, or work around a limit we have set.
We can withhold a reward, reverse one that was already credited, or close an account when we find fraud or a breach of these terms. Where we reverse something we will say why.
Brands
If you use WeBuzz to run a program, you are responsible for the program you create: the rewards you offer, the claims you make, honouring what you promised your ambassadors, and following the law that applies to your business and your marketing. You keep your own data, you grant us permission to process it to provide the service, and you confirm you have the right to give us the contact details you upload.
Your content
You keep ownership of what you put into WeBuzz. You give us permission to store and use it as needed to run the service for you.
Availability
We work to keep WeBuzz running and we do not guarantee it will never be interrupted. We may change or withdraw features. Where a change materially reduces something you depend on we will give notice.
Ending it
You can stop using WeBuzz and close your account at any time. We may suspend or end your access for a breach of these terms, for fraud, or where the law requires it. Rewards already properly earned and approved survive the closing of an account.
Disclaimers and limits
To the extent the law allows, the service is provided as it is, without warranties. Nothing in these terms limits liability that cannot be limited by law, including for fraud. Otherwise, and to the extent the law allows, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars, and we are not liable for indirect or consequential loss, including lost profits or lost earnings from a referral program.
Law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules.
Changes
If we change these terms we will change the effective date above, and for a significant change we will tell account holders directly.
